In the case of solicited proposals, these are those within the procurement stage – from the publication of the invitation to prequalify and bid up to the determination of the winning private proponent. In the case of unsolicited proposals, these are those within the competitive challenge stage – from the publication of the invitation to challengers up to the determination of the winning private proponent.
(1) unsolicited proposals submitted prior to the effectivity of the PPP Code that have been approved and are currently undergoing negotiation on the parameters, terms, and conditions of the project; and (2) unsolicited proposals submitted upon the effectivity of the PPP Code that have been accepted to proceed to negotiation by the appropriate implementing, pursuant to Section 58 of the PPP Code IRR
This includes the following projects: a) Projects approved and awaiting for issuance of invitation to bid – These are proposals that have already been approved by the appropriate approving body, but the Implementing Agency (IA) is yet to publish its invitation to bid (i.e. Invitation to Qualify/Pre-qualify and Bid for solicited proposals; and Invitation for Comparative Proposals for unsolicited proposals) (b) Projects ongoing deliberation - These are projects that are currently undergoing evaluation by the appropriate approving body. For national PPP projects: i. Ongoing deliberation by NEDA Board ii. Ongoing deliberation by ICC - Cabinet Committee (CC) iii. Ongoing deliberation by ICC - Technical Board (TB) iv. Ongoing deliberation by Head of IA/Governing Board (if approving body is not ICC/NEDA Board) For local PPP projects: i. Ongoing deliberation by Local Sanggunian/LUC Board ii. Ongoing deliberation by Local Development Council Executive Committee iii. Ongoing deliberation by Investment Coordination Committee, for Government Undertakings and/or Availability Payments using national government funds, if needed iv. Ongoing deliberation by Regional Public-Private Partnership Committee, if needed (c) Projects ongoing completeness check – These are proposals submitted by the Implementing Agency (IA) to the appropriate approving body for determination of completeness pursuant to Section 7(c) of the PPP Code, and Sections 29 and 40 of its IRR. If the proposal is determined to be complete, a Notice of Completeness shall be issued by the appropriate unit, which will commence the applicable approval period. If the proposal is determined to be incomplete, such proposal shall be returned to the implementing agency or the appropriate unit of the IA, as applicable.
In the case of solicited proposals, these would include the following projects: a) projects under development - proposals with approved project development support, with ongoing procurement of consultants for project development, or with ongoing preparation of feasibility study / business case; and b) projects under conceptualization - proposals under initial conceptualization phase, with ongoing preparation of project concept note, or with ongoing processing of project development support. In the case of unsolicited proposals, these would include the following projects: a) projects under evaluation by the implementing agency - unsolicited proposals undergoing evaluation (e.g. detailed evaluation) by the implementing agency prior to negotiation. b) projects endorsed to the implementing agency after completeness check - unsolicited proposals determined to be complete and endorsed by the PPP Center to the implementing agencies pursuant to Section 10 of the PPP Code.
These are projects where proponents are already given authority to operate and maintain the facilities; facilities are already being used by the end-users.
Projects with ongoing construction activities.
Projects where conditions precedent for construction have not yet been fulfilled
Notice of Award (NOA) has been issued to the winning private proponent(s).
Awarded projects awaiting verification by IA on status of the project.
Projects which have reached the end of their cooperation period/concession period.
Pursuant to Section 16 of the IRR of the PPP Code, this consolidated List of PPP Projects shall be updated as soon as new project updates are received from implementing agencies.
