Public-Private Partnership Center

The PPP Center Legal Service renders legal advice in the formulation, review, and improvement to Public-Private Partnership policies, Implementing Rules and regulations (IRR), as well as other related operational policy concerns. It also reviews and provides recommendations to address potential litigation arising from PPP contract variations. Another service we provide is the conduct of legal research and studies. We also maintain a database on, and monitor laws, administrative issuances, court decisions, and other legal issuances relative to PPP.

In the performance of the above functions, the PPP Center Legal Service:

1. Provides legal advice and assistance in the formulation of PPP policies, including proposed legislation and implementing rules and regulations;
2. Provides legal advice and assistance on PPP projects and contracts and other related documents including screening, negotiation and verification of projects, and also in the monitoring and enforcement of PPP projects;
3. Prepares and/or reviews contracts, agreements, transaction documents, and other related documents under the Build-Operate Transfer Law, the Government Procurement Reform Act and other related laws;
4. Reviews contracts and transaction documents prepared by technical Advisors/Consultants for PPP projects;
5. Prepares legal opinions/comments/advice/ relative to PPP project development and/or facilitation and assistance;
6. Provides legal advice on operational matters;
7. Provides legal advice and assistance to all Services of the PPP Center in the performance of their mandated functions, roles and responsibilities;
8. Reviews internal documents, issuances, communications and other related documents of the PPP Center and its officials and employees;
9. Provides legal advice on contracts/assistance to the PPP Center and PPP Center officials and employees.

The PPP Center Legal Service is crucial in ensuring that all PPP transactions, bids, and all other PPP project documents are legally sound based on existing legal and regulatory frameworks and policies.
