Pursuant to the Revised 2022 Implementing Rules and Regulations (IRR) of the Build-Operate-Transfer (BOT) Law, the PPP Governing Board is formulating guidelines on the amount of appeal fees for disqualified proponents during the pre-qualification stage.
The guidelines aim to set a fair and appropriate amount of appeal fees for disqualified proponents which shall not discourage potential appellants from challenging the disqualification decision; and at the same time, dissuade non-serious bidders on filing appeals which can impede the procurement process for PPP projects.
In this regard, we invite stakeholders to submit inputs and comments on the proposed guidelines until September 27, 2023. Comments and inputs must be submitted via email to the Policy Formulation Division of the PPP Center at policy@ppp.gov.ph.
