Following the approval by the Build-Operate-Transfer (BOT) Law Implementing Rules and Regulations (IRR) Committee, the Revised 2022 IRR of the BOT Law has now been published in a newspaper of general circulation. The measure shall be effective on October 12, 2022.

Socioeconomic Planning Secretary Arsenio M. Balisacan of the National Economic and Development Authority emphasized the “need to establish the right policies, institutional frameworks and regulations that will further promote competition and transparency in our PPP regime.”

“As our country progresses, we must not hesitate to review and re-examine these policies to make sure that these continue to be fair and conducive for a Philippines where Filipinos can enjoy a strongly rooted, comfortable, and secure life,” he added.

The approved Revised 2022 IRR was the result of inter-agency technical meetings and of a public consultation.

Following concerns raised by the private sector regarding the April 2022 iteration of the IRR, inter-agency technical meetings among the BOT IRR Committee members were conducted to come up with proposed revisions to the rules.

On September 13, 2022, stakeholders and interested parties were invited to provide comments and inputs on the proposed amendments in a public consultation held at the Asian Development Bank headquarters in Mandaluyong City.

The BOT Law IRR Committee deliberated on the comments received from the consultation and approved the proposed amendments in its meeting on September 15, 2022.

Aside from Secretary Balisacan and Secretary Benjamin E. Diokno of the Department of Finance who serve as Chair and Co-Chair of the BOT Law IRR Committee, respectively, the other members of the Committee include the following: Secretary Ma. Antonio Yulo-Loyzaga of the Department of Environment and Natural Resources, Secretary Ivan John E. Uy of the Department of Information and Communications Technology, Secretary Benjamin C. Abalos, Jr. of the Department of the Interior and Local Government, Secretary Raphael Perpetuo M. Lotilla of the Department of Energy, Secretary Jaime J. Bautista of the Department of Transportation, Secretary Manuel M. Bonoan of the Department of Public Works and Highways, Secretary Alfredo E. Pascual of the Department of Trade and Industry, Undersecretary Domingo F. Panganiban of the Department of Agriculture, and Executive Director Ma. Cynthia C. Hernandez of the PPP Center.
