Section 56 of the IRR of the PPP Code (Treatment of More Than One Unsolicited Proposal for the Same or Similar Project) provides that similar proposals may be entertained within ten (10) calendar days from the receipt of the first USP by the PPP Center. Any same or similar proposal that has been received by the PPP Center within this 10-calendar day period shall be subject to completeness check pursuant to Section 52 (Submission of an Unsolicited Proposal to the PPP Center for Determination of Completeness and Appropriate Approving Body). Section 56 of the IRR further provides that if the PPP Center receives similar proposal/s beyond the 10-calendar day period, said submissions shall no longer be assessed for completeness and shall be returned to the Private Proponent/s. Such Private Proponent/s may instead participate in the comparative challenge process, pursuant to Section 10(e) of the PPP Code.

This draft policy instrument aims to provide: (a) a set of criteria that shall guide the PPP Center on determining whether a USP it receives for determination of completeness and appropriate approving body is a “same” or “similar” project that will warrant it to no longer assess said USP, pursuant to Section 56 of the PPP Code IRR; and (b) rules and procedural guidelines that shall govern USPs determined to be “same” or “similar” pursuant to the Guidelines; as well as, (c) serve as guidance to IAs as to what sameness and similarity entails, particularly in dealing with USPs that were submitted to the IA prior to the effectivity of the PPP Code and that have been granted OPS but are still pending approval by the effectivity of the Guidelines, and Solicited Projects with similar scope and/or objective to a complete USP endorsed by the PPP Center, pursuant to Section 10(d) of the PPP Code and Section 54 of the PPP Code IRR.
