Understanding PPP for Infrastructure and Development Projects

SESSION 1:
Introduction to Public-Private Partnership (PPP) & the Philippine PPP Program

Objective/s:

  • Provide a common understanding on the fundamentals of PPP/ BOT-type of projects

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Explain/differentiate basic PPP models
  • Analyze and evaluate appropriateness of PPP /BOT mode as an implementation option for a particular project
  • Explain benefits of using a PPP/BOT structure

SESSION 2:
Policy, Legal, and Institutional Framework for PPP/BOT in the Philippines

Objective/s:

  • Provide an overview on the policy, legal and institutional framework for PPP/BOT in the Philippines

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Explain the PPP/BOT policy of the government
  • Differentiate BOT modalities
  • Explain the PPP/BOT institutional arrangements in the Philippines
  • Identify applicable PPP/BOT-related laws and formulate a strategy to deal with conflicting laws
  • Identify the level of required approvals depending on the magnitude of the project
  • Formulate strategies to expedite grant of approval by appropriate approving entities
  • Evaluate and process unsolicited proposals in a comprehensive and systematic manner
  • Determine optimal financing structure for a particular PPP/BOT  project
  • Interpret results of financial analysis
  • Justify a recommendation to implement a potential PPP/BOT project

SESSION 3:
PPPs in Local Infrastructure & Development Projects: Processes and Cycle

Objective/s:

  • Outline fundamentals of implementing a PPP/BOT project.
  • Discuss importance of public and private collaboration during project development stage

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Outline the factors to be considered in selecting projects for PPP
  • Explain the project development and planning process as well as the project development cycle
  • Identify corresponding organization and management aspects
  • Describe the importance of fostering a public-private collaboration through public-private dialogue
PPP Project Development

SESSION 1:
Project Identification

Objective/s:

  • Review of the LGU Multi-year Investment Program and Multi-Variate Analysis (MVA)

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Use the MVA tool together with the social cost benefit analysis (SCBA) in analyzing potential LGU PPP project/s’ viability, value for money principle, among others.

SESSION 2:
Project Management

Objective/s:

  • Discuss the importance of developing an effective project management plan
  • Identify the steps on entering technical stages in planning, facilitating and controlling PPP programs and projects

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Understand the basic concepts of project planning and control, identifying and managing project risks and issues, and high-level progress monitoring and reporting requirements for PPP program and projects

SESSION 3:
PPP Proposal Presentation

Objective/s:

  • Review of the project proposal components in the context of PPP: Technical Assessment Study, Demand/Market Study, Social Cost Benefit Study, Environment, Social and Gender Impact Analysis, Financial Analysis, and Market Sounding

Expected Learning Outcomes:

  • On completion of the session, the participants should be able to:
  • Contextualize their existing knowledge on project proposal components for PPP projects

SESSION 4:
Project Structuring and Risk Management

Objective/s:

  • Equip participants with basic knowledge on identifying and understanding the different kinds of project risks and on managing and effectively mitigating risks involved in PPP

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Come up with Risk Assignment tables of a certain project
  • Attribute risks relative to the project
Contract Drafting

SESSION 1:
Drafting the PPP Agreement

Objective/s:

  • Understand structuring an appropriate, complete and concise PPP contract/agreement and the methods to use in defining the true “win-win” contract.

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Explain/differentiate basic PPP models
  • Analyze and evaluate appropriateness of PPP /BOT mode as an implementation option for a particular project
  • Explain benefits of using a PPP/BOT structure

SESSION 2:
Drafting the Minimum Design and Performance Standards/Specifications (MPSS)

Objective/s:

  • Provide working knowledge on drafting the MPSS and KPIs of PPP projects

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Come up with an MPSS in accordance to a specific PPP project
  • Come up with Key Performance Indicators vis-à-vis the MPSS
Project Approvals

SESSION 1:
Project Approvals

Objective/s:

  1. Go through the project approval process, the requirements of various national and local approving bodies as well as critical areas and scope of the PPP project review and approval phase

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Understand the project approval process and follow it on their respective projects in the future
PPP Procurement

SESSION 1:
RA 7718 (BOT Law and its IRR) Procurement Process

Objective/s:

  • Understand the modes of procurement for PPP projects

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Differentiate traditional government procurement to PPP procurement
  • Understand the different stages of public bidding in RA 7718 such as pre-qualification, tendering, opening of bids, bid evaluation, and award of contract
Contract Negotiation

SESSION 1:
Contract Negotiation

Objective/s

  • Discuss strategies for negotiating PPP contracts

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Explore competitive and collaborative negotiation strategies to reach a successful contracts and financial close.
Managing the PPP Agreement

SESSION 1:
The PPP Agreement

Objective/s

  • Discuss project coordination and ensuring compliance to the agreed on technical specifications and monitoring the construction and/or operations of the PPP project

Expected Learning Outcomes:
On completion of the session, the participants should be able to:

  • Measure outputs, monitor and regulate performance, liaise effectively, settle disputes, and report progress using prescribed monitoring guidelines in the period of their respective project.
